The menu does not appear...

First of all I would like to praise the developers for bringing the game out for free and the continuing with the development of this great game. I had the original back in the days but it's now probably in some box in the basement. Seeing it today I decided to download the game and give it a go one more time (but probably many, many more times). Installation went smooth and I get to the main menu where I can do pretty much everything the menu allows you to do. Now, I start my game, complete the first mission of the campaign, save the game and continue to play the next mission. All would be well, alas I was interrupted by a phone call which would result in me leaving. Ok, let''s save the game and go... And here is where my problem begins... The menu does not appear upon pressing the Esc key. I have tried every key on the keyboard just in case but none of them brings out the menu. So now I can't save the game or quit it in a normal fashion without having to resort to the task manager or Alt-Tabbing / Alt-Escaping to desktop and right click the task the task bar to quit it from the context menu.
Otherwise the game runs super-smooth on a high resolution.

I have a Win7 64-bit OS
Intel i3 processor
Ati Radeon HD5750 1GB gfx card
4GB of system memory

No process other then native windows, anti-virus (Microsoft Security Essentials) and ATI control panel are running while I'm playing.

And yes... i have checked out my keyboard first - the Esc key works perfectly and without fault.

So far I have tried the game in many different resolutions (windowed and fullscreen), switched the keyboard just in case, rebooted the computer but to no avail.

this happened to me once before too, try getting out and back in - restarting the game. usually it only happens once in a while

Odd. reset your keymap, (click the trashcan icon a few times).
If it still does it, do --debug input and play around with hitting the key, and I can look at the logs.
